Terms of Service - Brokey Presets

Welcome to Brokey Presets. These Terms of Service ("Terms") govern your use of our website and your purchase of digital products from us. By placing an order or using our store, you agree to these Terms.

Brokey Presets is operated by Brokezart, based in Rotterdam, the Netherlands.

2. Our products

We sell digital audio products, including vocal presets, mixing/mastering presets, and related digital files ("Products"). All Products are delivered electronically — no physical items are shipped.

3. License to use presets

When you purchase a Product from us, we grant you a non-exclusive, non-transferable license to use that Product, subject to the following:

• You may use our presets in your own music productions, releases, and commercial projects (e.g. songs you release, sell, or stream).
• You may not resell, redistribute, share, sublicense, or repackage the preset files themselves (in original or modified form) as a standalone product, sample pack, or preset pack.
• You may not claim authorship of the presets themselves, or represent that you created them.
• The license applies to the individual purchaser only; sharing your purchased files with others is not permitted.
• We retain all intellectual property rights in the Products. Purchasing a Product gives you a license to use it as described above — it does not transfer ownership or copyright of the underlying preset/plugin data to you.

4. Orders and payment

• Prices are displayed in the currency shown at checkout and may include or exclude VAT depending on your location, as shown at checkout.
• Payment is due in full at the time of purchase, processed via our third-party payment provider.
• We reserve the right to refuse or cancel an order (e.g. suspected fraud, pricing errors, or technical issues), in which case you will be refunded.

5. Delivery

Products are delivered digitally, typically via instant download or an email with a download link, immediately or shortly after payment is confirmed. It's your responsibility to ensure the email address provided at checkout is correct and that you download your files promptly. Contact prodbrokey@gmail.com if you don't receive access within a reasonable time.

6. Right of withdrawal (EU customers)

Under EU consumer law, you normally have a 14-day right to withdraw from an online purchase. However, this right does not apply to digital content once download or streaming has started, provided that:

• You have given your prior explicit consent for delivery to begin before the withdrawal period ends, and
• You have acknowledged that you thereby lose your right of withdrawal.

By completing your purchase and confirming this at checkout, you agree that download of the Product may begin immediately and that you waive your right of withdrawal once the download has started. If a Product has not yet been downloaded, contact us and we will review withdrawal requests on a case-by-case basis.

7. Refunds

Because our Products are digital and delivered instantly, all sales are generally final once a file has been downloaded, except where:

• The Product is defective, corrupted, or materially not as described.
• Required by applicable consumer protection law.

If you experience an issue with a Product, contact prodbrokey@gmail.com and we'll do our best to resolve it (e.g. re-sending files, troubleshooting, or a refund where appropriate).

8. Prohibited use

You agree not to:

• Share, pirate, or redistribute purchased files.
• Use our Products to create competing preset/sample packs.
• Attempt to circumvent any purchase, license, or access restrictions.
• Use the store for fraudulent or unlawful purposes.

We reserve the right to refuse service, cancel orders, or restrict access for violations of these Terms.

9. Intellectual property

All content on the Brokey Presets store — including audio demos, branding, artwork, website design, and text — is owned by us or our licensors and protected by copyright and other intellectual property laws. You may not copy, reproduce, or use this content outside of using the Products as licensed under Section 3.

10. Limitation of liability

To the extent permitted by law, Brokey Presets is not liable for indirect, incidental, or consequential damages arising from your use of our Products or store, including issues arising from third-party software, plugins, or digital audio workstations used alongside our Products. Our total liability for any claim is limited to the amount you paid for the relevant Product.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the store after changes means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your country of residence if you are a consumer in the EU.
